Field Service Agreement
For clarity, the words “you” and “your” refer to the person purchasing or receiving service(s), and the words “we,” “us,” and “our” refer to Homestead Internet LLC, its parent company, affiliates and their authorized, independent third parties performing services on our behalf. By purchasing or receiving service you accept these terms. Our employees and agents have no authority to alter these terms.

AUTHORIZATION:
AGE AND ACCOUNT SETUP: You represent that you are at least 18 years of age and have the right and ability to enter into this Agreement. You agree that you are responsible for installing, establishing, and setting up, and for verifying and maintaining, the account, options, settings, and other parameters under which the Service is used, including (without limitation) all related passwords and user identification information. These account functions may be performed only by a person at least 18 years of age, without exception. years old must be present at all times to authorize/approve all work.

SAFETY: We require a safe working environment and reserve the right to refuse or reschedule service due to conditions we deem dangerous or unsafe, including but not limited to possible code violations, extreme temperatures, natural disasters, or other hazards - real or perceived. Some items to be hauled away may require additional equipment/personnel to safely remove, which may result in a delay or rescheduling of the haul-away.

ACCESS ON-PREMISES:
Homestead Internet requires full access to products to be installed, and serviced, access to the premises, your cooperation, and electrical power. Some services may not be performed if minimum system requirements are not met or technical needs are encountered (including wiring or overcoming physical/technical barriers) or other requirements are unusual or extensive as determined by us. Service may be denied and a cancellation fee charged if we arrive for a scheduled appointment and you are not present or we determine that we do not have appropriate access or cooperation from you.

As a condition of receiving services, Customer authorizes Homestead Internet LLC to enter the premises to construct, install, maintain, inspect, and/or replace all other Equipment necessary to provide Services. Furthermore, as the owner of the premises at which the Services are provided, Customer will, upon request, grant to Homestead Internet LLC a perpetual easement without charge on and through premises to construct, install, maintain, inspect, and/or replace outlets, transmission lines, and all other Equipment necessary to provide Services to Customer and others. In the event you are not the owner of the premises upon which service installation is requested, you warrant to Homestead Internet LLC that you have obtained the consent of the owner of the premises for Homestead Internet LLC to make installation and maintenance contemplated by this Agreement. If you are not the owner of such premises, you agree to indemnify Homestead Internet LLC harmless from and against any claims of the owner arising out of the performance of this Agreement.

You acknowledge and agree that Homestead Internet LLC or its designated service provider may be required to access your premises and/or computer system in order to install and maintain the components necessary for you to access the Service (the “Subscriber Equipment”). This may include opening your computer to install, repair, or replace equipment or to install software on your computer at your location. By accepting this Agreement and scheduling a service or installation visit, you hereby authorize Homestead Internet or its service provider to access your computer for the purpose of installing, repairing, or replacing Subscriber Equipment for the purpose of facilitating your access to the Service. Neither Homestead Internet nor its service provider shall have any liability whatsoever for any losses resulting from installation, repair, or other services, including without limitation damage to your premises or computer, or loss of software, data, or other information from your computer.

OUTLETS:
We will not move, alter, or install electrical outlets. You must have any necessary electrical work performed prior to service.
3RD PARTY CONTRACTORS: THE SERVICES MAY BE PERFORMED, AT OUR DISCRETION, BY EITHER OUR OWN EMPLOYEES OR ONE OF OUR AUTHORIZED, INDEPENDENT 3RD PARTY CONTRACTORS. WE REQUIRE OUR 3RD PARTY CONTRACTORS TO CONDUCT A BACKGROUND CHECK ON ANY PERSON THEY HIRE WHO WOULD ENTER YOUR PLACE OF BUSINESS.

ESTIMATES AND FEES:
We will provide an estimate of costs for work to be performed where the service was not already purchased. You agree to pay up to the estimated amount. After product evaluation but before service begins, we will obtain your approval for services that exceed your estimate.

ADDITIONAL COSTS: We will provide an estimate prior to performing work that requires an additional cost beyond the service already purchased. Additional costs and fees may apply to orders where the service required exceeds the scope of work for services already purchased and/or services performed outside of the standard service area as called out during the scheduling process. Additional costs are payable by check or credit card.

PERMITS:
We will charge you at the time of installation the actual cost of any permit fee(s) required by local code or rule for the services performed.

CHANGES/CANCELLATIONS:
You must notify us of any order change/cancellation at least 24 hours in advance of your scheduled appointment. Orders canceled less than 24 hours in advance of your scheduled appointment may be subject to a cancellation fee. NON-REFUNDABLE:
The delivery fee is nonrefundable once delivery is completed. All other service fees (e.g., installation) are non-refundable once service begins.

WORKSPACE CONDITIONS:
We are not responsible for moving any furniture or valuables. The work area must be free and clear of any obstacles or debris, and these items must be removed prior to our arrival.
​
LATH AND PLASTER:
We cannot warrant that installations on lath and plaster walls will not result in wall cracks. We will try to eliminate the possibility, but due to the nature of that type of construction, we are not responsible for any resulting damage to any wall from our services.

CABLE/SATELLITE/INTERNET:
We are not responsible for signal strength or degradation due to faulty equipment or lines. If the cable/satellite/internet provider modifies any part of our work, you will be charged a service fee of $99.99 plus applicable taxes to reestablish system functionality per the original installation scope of work.

PC/TABLET USE:
Some services may require access to your PC/tablet. We may use tools we deem necessary for diagnostics and repair, including remote access. We may install software that allows you to obtain additional technology services. For software installations, we may accept End User License Agreements on your behalf.

YOUR DATA:
It is your responsibility to back up any data and software on your product and remove any media (e.g., memory card) before service begins. We will NOT back up any data/software unless you specifically request us to do so before any service begins and pay an additional fee. Whether or not you request data backup service from us, we are not liable for any loss/alteration/corruption of any data or media.

PRODUCT PICK-UP:
If we remove your product for service and damage or loss occurs while in our custody, you are entitled to product repair, replacement, or reimbursement of the product’s fair market value, as determined by us and at our sole discretion. The replacement may be made with a product with comparable quality and features.
PRODUCT SECURITY: You are solely responsible for securing your product upon delivery and protecting it against damage or loss.

DISCLAIMER:
We will not be liable for any failure or delay in performance due to any cause beyond our control. If our ability to render services is impaired by you or circumstances beyond our control, we may elect to not provide services. For any uninstallation services provided, we are not responsible for repairing any changes or damages made to the premises. We will not disassemble, deconstruct, or break down products for haul-away service even if necessary for removal. Neither Homestead Internet nor its service provider shall have any liability whatsoever for any losses resulting from installation, repair, or other services, including without limitation damage to your premises or computer, or loss of software, data, or other information from your computer.
TAMPERING/MISUSE/LOST/STOLEN.
Customer shall not alter, misuse, repair, or in any manner tamper with the Equipment or outlets, or remove from the Equipment any markings or labels. Equipment cannot be removed from Customer premises and used in another location. The customer is responsible for the safekeeping of all Equipment. If any Equipment is destroyed, damaged, lost, or stolen while in Customer possession, Customer shall be liable for the cost of repair or replacement of the Equipment.

LABOR WARRANTY:
We provide a 30-day warranty on custom-installed integrated antenna systems installed. If a service call is needed within the applicable warranty period, you will be charged $99.99 plus applicable taxes at the time of scheduling - which will be refunded to you if we determine, at our sole discretion, that there was a defect in our workmanship. This warranty begins from the date of service completion.

LIMITATION OF LIABILITY AND RELEASE:
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, (1) EXCEPT FOR THE LABOR WARRANTY AND LIMITED INSTALLATION WARRANTY IN THESE TERMS, WE MAKE NO AFFIRMATIVE WARRANTIES AND GRANT ONLY THOSE WARRANTIES IMPLIED BY LAW THAT CANNOT BE EXCLUDED BY CONTRACT UNDER STATE LAW; AND (2) WE ARE NOT LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES - INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOST PROFITS/BUSINESS, DATA LOSS OR CORRUPTION, DATA RECOVERY/RECREATION, OR OTHER INTANGIBLE DAMAGES ARISING FROM SERVICE. THESE LIMITATIONS DO NOT LIMIT OR EXCLUDE LIABILITY FOR GROSS NEGLIGENCE, INTENTIONAL MISCONDUCT, OR FRAUD. You
affirmatively release and hold us harmless from any loss, liability, or damage that you, or the owner or lessee of the premises, may suffer - including but not limited to any premises alterations (e.g., changes to walls, baseboards, floors). Some states do not allow limitations or releases on liability, so this limitation of liability and release may not apply to you.

PHONE CALLS:
We will call you at the phone number you provided (including any mobile numbers) to inform you about order status, scheduling, and service requirements. Calls may be live or pre-recorded and made via an automated dialing system. Voice and Data rates may apply.

IMPORTANT
BY SIGNING THE MEMBERSHIP SERVICES AGREEMENT AND/OR PAYING FOR THE INITIAL HARDWARE INSTALLATION FEE OR USING THE SERVICE, YOU AGREE TO COMPLY WITH ALL OF THE APPLICABLE TERMS, CONDITIONS AND PROVISIONS CONTAINED IN THE MEMBERSHIP SERVICE AGREEMENT, FIELD SERVICE AGREEMENT AND ANY APPLICABLE SERVICE TARIFFS, TERMS AND CONDITIONS OF SERVICE, THE ACCEPTABLE USE POLICY AND YOUR SELECTED SERVICE PLAN OR SERVICE PACKAGE. IF YOU DO NOT ACCEPT THESE TERMS AND CONDITIONS OF SERVICE, PLEASE NOTIFY US PRIOR TO INSTALLATION AND WE WILL CANCEL YOUR SERVICE.
