Membership Service Agreement

IMPORTANT NOTICE: By accepting these Terms of Service and using the products and services provided to you, you are bound by the terms and conditions listed hereafter and any wireless carrier “Service Agreement”, “Acceptable Use Policy”, or related document which governs a user’s responsible use of network resources and services as referenced by the wireless carrier on their website. Additional terms and conditions may also apply. A minimum summary is referenced below for your benefit.

  1. You (“you” or “Member”) are being provided with an Internet access service (“Service”). However, note that this Service does not include other applications such as Internet telephone or cable TV that might be provided with INTERNET service by other vendors. We are not involved in the creation or provisioning of the Service. The Provider provides the Service via its wireless network which uses cell sites and frequencies licensed by the FCC. Note that this Service may not be accessible in all areas, and will only function when within range of the Provider's network, subject to change at their discretion. Be aware too that there may be disruptions or unavailability due to maintenance, emergencies, inclement weather, or other factors beyond our control or those of our partner networks. It is possible too that your modem or other hardware used for the Service will require resetting or reconfiguration in event of power failure/disruption. We and our partners are not liable for any failure/lack of performance about this Service.

  2. In addition to abiding by these Terms of Services, usage of this Service is also subject to Provider's then-current Acceptable Use Policy ("Provider AUP") & End User Terms & Conditions ("Provider T&C"). Please note that they reserve the right to change said policies at any time without advance notice.

  3. Be aware also that usage limits applicable to this Service may be established by Provider which has no connection with us/our partners -these limits are subject to changes without prior notification from the Provider end.

ONE-TIME HARDWARE SETUP FEE

When you become a member, you are responsible for paying a one-time hardware setup fee. This fee covers the initial integration and setup of your subscription devices, as well as administration/support costs.

Please note that your membership provides access to products and services - it does not give you ownership of any equipment provided. However, this fee can be applied to an upgrade or used towards a membership plan transfer where applicable.

MEMBERSHIP FEE

Membership start-date is calculated as the day on which membership devices have been installed and will renew one month after the membership start date. Membership dues will automatically be charged to the credit card on file. All subscriptions must have a valid credit card on file for autopay subscription renewal.

MEMBERSHIP DEVICE

Membership start date is calculated from the day of device installation, and members will be billed for their monthly membership dues on an automatic recurring basis. All subscriptions must have a valid credit card associated with them for autopay subscription renewal.

​

AGE AND ACCOUNT SETUP

You represent that you are at least 18 years of age and have the right and ability to enter into this Agreement. You agree that you are responsible for installing, establishing, and setting up, and for verifying and maintaining, the account, options, settings, and other parameters under which the Service is used, including (without limitation) all related passwords and user identification information. These account functions may be performed only by a person at least 18 years of age, without exception.

INSTALLATION OF MEMBERSHIP EQUIPMENT

You acknowledge and agree that Homestead Internet be required to access your premises and/or computer system to install and maintain the components necessary for you to access the Service (the “Membership Equipment”). This may include opening your computer to install, repair, or replace equipment or to install software on your computer at your location. By accepting this Agreement and scheduling a service or installation visit, you hereby authorize Homestead Internet or its service provider to access your computer for the purpose of installing, repairing, or replacing Membership Equipment for the purpose of facilitating your access to the Service. Neither Homestead Internet nor its service provider shall have any liability whatsoever for any losses resulting from installation, repair, or other services, including without limitation damage to your premises OR third-party contractors: the services may be performed, at our discretion, by either our own employees or one of our authorized, independent third-party contractors. We require our third-party contractors to conduct a background check on any person they hire who would enter your place of business.

MONEY BACK GUARANTEE

Each membership includes 30 days from the date of receiving the provided equipment. If the provided devices or service does not meet members’ expectations, customers will have till the end of the 30th day to schedule an on-site appointment, for the pickup of membership devices. The customer must be available and present to allow a Homestead Internet technician or approved third party to recover Homestead internet-provided hardware. The hardware installation fee and the first month’s membership plan will be refunded when all membership devices have been returned to Homestead Internet.

The scheduled date to pick up equipment must be scheduled no later than 10 days after the cancellation request. Cancellation requests outside the 30 days will not be entitled to a refund for either the one-time installation fee or the monthly membership plan.

​

CANCELLATION

All devices are the property of Homestead Internet and need to be returned to cancel your subscription. Cancellation of any subscription/services can only take place when membership devices have been returned to Homestead Internet. Customers will have to schedule an on-site appointment and must allow a Homestead Internet technician or an approved third party to recover Homestead internet-provided hardware. The scheduled date to pick up equipment must be scheduled no later than 10 days after the cancellation request.

You may request to cancel service at any time by submitting a cancelation request via member account setting or emailing team@Homesteadinternet.com and directly surrendering leased equipment to Homestead Internet in accordance with your Agreement. If service is disconnected or canceled prior to the end of the applicable Minimum Term, you agree to pay Homestead Internet a recovery fee for the promotion Terms and Conditions. In addition to any applicable recovery fee, account holders are liable for all services rendered by Homestead Internet prior to your notice of intent to terminate service until the time that all leased equipment is returned. Information regarding an intended moving or disconnection date must be communicated to Homestead Internet during normal business hours.

Exceptions: In some cases, Homestead Internet will allow for customers to return the devices via mail, in these cases, cancellation of the subscription will happen once the associated tracking information states that the unit has been received by Homestead Internet. Exceptions are made at the discretion of Homestead Internet.

TAMPERING/MISUSE/LOST/STOLEN

Customer agrees not to modify, misuse, repair, interfere with, or tamper with the Equipment or outlets; remove any markings or labels from it, and not to take it away from Customer premises for use elsewhere. Furthermore, Customer shall remain responsible for the safekeeping of all Equipment and shall be liable for the cost of repair or replacement of said Equipment in case it is destroyed, damaged, lost, or stolen during their possession.

TERMINATION OF MEMBERSHIP

We may terminate this subscription and any services we provide to you at our discretion, at any time. This termination may occur if:

​

  1. We determine that you or any user of your service has violated applicable laws while using our membership.

  2. You have violated any portion of the Service Provider AUP or Terms and Conditions of our Platform policies.

  3. We believe that your current or future actions may legally harm Homestead Internet, our business interests, or a third party.

  4. You deceive or commit theft from us.

  5. You fail to pay your bill or have a history of billing issues with Homestead Internet. 6a. Harass, threaten, or use vulgar, inappropriate language toward our representatives; 6b. “Spam”, or engage in other abusive messaging or calling;

  6. Modify or tamper with any device that is property of Homestead Internet;

  7. Engage in any detrimental behavior including but not limited to data abuse, torrenting, or other forms of misuse of any services offered by Homestead Internet.

Additionally, the customer assumes the risk of loss, theft, or damage to all Equipment prior to termination and cancellation of their membership and must return requested devices within five days after termination for avoiding replacement costs otherwise charged to their payment method once on file in accordance with applicable law.

 

NON-PAYMENT

If you are terminated for non-payment by Homestead Internet, the Early Termination Fee and the Unreturned Equipment Fee will be due immediately upon termination. Failure to pay these fees may result in further legal action being taken against you.

PLAN DEVICE REPLACEMENT FEES

We offer add-on equipment and devices to our member plans in order to accommodate their needs for indoor Wi-Fi, Outdoor Wi-Fi, and specific antenna(s) for long-range applications. It is important to note that no modifications should be made to the devices–this includes the addition of any adhesives, addition of stickers, or removal of labels. Devices that are not returned or that are returned in an unsatisfactory manner will be subject to a device replacement fee. The base Standard plan replacement fee will start at $1,500.00; the Elite plan at $2,000.00; and the Premium plan at $2,500.00. For add-on equipment and devices that are not returned or are returned in an unsatisfactory manner, there will also be a device replacement fee equal to the then-current market value. Indoor Wi-fi extender replacement costs can range from $200-$450 for each unit; Outdoor Wi-fi extender replacement costs can range from $250-$750 for each unit; and long-range antenna replacements can start at $250-$1,000 for each unit.

If you have an issue with the Service, please contact us for resolution at team@homesteadinternet.com. This notice is applicable for dispute resolution.

DATA  ABUSE

At Homestead Internet, we strive to provide our members with modems, devices, and unlimited data plans that enhance their user experience. To ensure this continues, we ask members to use these membership plans responsibly. Using practices such as Peer-to-Peer (P2P) or Network sharing can cause an excessive amount of data usage and result in account suspension or termination. Any fees associated with misconduct will be the sole responsibility of the member.

BREACHING PROVIDERS ACCEPTABLE USE POLICY

At the Provider’s sole discretion, (a) the member is in breach of their Acceptable Use Policy; (b) a member’s use of the membership is prohibited by law or is disruptive to, adversely impacts, or causes a malfunction to the membership equipment, the Wireless Service Provider and/or it’s partners’ servers or other equipment, or the use and enjoyment of other users; (c) a member acts in an abusive or menacing manner when dealing with The Cellular Service Provider’s technical support staff, customer service staff or any other of the Wireless Service Provider’s employees or representatives; (d) the Cellular Service Provider receives an order from a court to terminate a member’s service; or (e) the Cellular Service Provider for any reason ceases to offer the membership, then the Cellular Service Provider at its sole election may terminate or suspend such member’s service immediately without notice. For a termination in accordance with this paragraph, the member remains liable for all unpaid fees and other charges accrued or otherwise payable under the terms of this Agreement, any equipment charges set forth herein, if applicable.

 

We may terminate this subscription with you, and or any services we provide at our discretion, at any time, or if we determine that you or any user of your service,

INTERNET SPEEDS

Actual internet speeds may vary depending on several factors including the capacity and performance of your computer, its configuration, wiring, any wireless connections, the destination of the data, traffic on the internet or on your internal network, congestion on the network and the general speed of the public internet. These variations may affect your online experience, including streaming video quality and download speeds.

SUBSCRIBER RESPONSIBILITY

You shall be responsible for all access to and use of the Membership devices and the services through your account or password(s) and for any fees incurred for goods or services purchased thereon, or any other expenses incurred because of any use of your account. You promise to pay the amounts billed for any such goods or services, along with any related fees, taxes, and charges. Use of your account is limited to family members residing at your permanent residence. You acknowledge that you are aware that areas accessible on or through the Service may contain material unsuitable for minors (persons under 18 years of age). You agree to supervise usage of the Service by minors who use the Service through your account. You hereby ratify and confirm any obligations a minor using your account enters or assumes and any promises or permissions such minor makes or gives. You agree to: (1) provide us with true, accurate, current, and complete information about yourself; and (2) promptly update this information to keep it true, accurate, current, and complete.

CHANGES IN SERVICE/CHARGES

Homestead Internet reserves the right to alter or discontinue its Services and associated fees, so long as such changes comply with applicable laws. Customers shall be given thirty days' notice of any increase in charges or other changes to Services.

​

TECHNICAL SUPPORT

Homestead Internet will make reasonable efforts to maintain its system and respond to service calls in a timely manner. Homestead Internet will repair or replace Equipment damaged due to reasonable wear and tear or technical malfunction. Physical damage to Equipment caused by intentional or negligent misuse is the Member's sole responsibility in such event, the member is responsible to pay the cost of repair or replacement.

ACCESS ON-PREMISES

If Customer is not the owner of the premises, Customer warrants that they have the authority to grant such access and easement to Homestead Internet, or that they have obtained consent from the owner of the premises for Homestead Internet to install and maintain Equipment during the duration of the membership.

SECURITY

We homestead internet, are merely a distributor of internet service provided by a third-party (the “provider”), which is currently, Verizon, AT&T, or T-Mobile USA, Inc. Or an affiliate of that company but is subject to change at any time. We do not control the service or carrier practices with respect to the service. These practices are controlled by the provider, including practices with respect to data caps and allowances; throttling policies; privacy policies; network congestion management practices; the blocking or rate-controlling of specific protocols; the inhibition or favoring of specific applications; network security protections; and the attributes and characteristics of the service. Carriers like the provider are required by the federal communications commission (“FCC”) to provide the following types of disclosures to their customers.

Under each category of disclosure shown below, we inform you of our involvement (if any) in the acts or practices contained in that category and we direct you to certain provider disclosures on its website for its disclosures with respect to such categories. We offer no warranty as to the accuracy or completeness of the provider’s disclosures referred to below. We do not control those disclosures and have no or very limited access to the data or activities underlying those practices.

CONGESTION MANAGEMENT

We do not own, operate, maintain, or control the Service, and do not engage in network congestion management practices. The Provider uses network congestion management practices that may interfere with the speed or the availability of your Service. You should review the Provider’s disclosures for the network congestion management practices that may affect your use of the Service, including descriptions of congestion management practices; types of traffic subject to practices; purposes served by practices; practices’ effects on end users’ experience; criteria used in practices, such as indicators of congestion that trigger a practice, and the typical frequency of congestion; usage limits and the consequences of exceeding them; and references to engineering standards, where appropriate.

APPLICATION SPECIFIC BEHAVIOR

We do not own, manage, maintain, or control the Service and we do not engage in blocking or rate-control of any specific protocols or protocol ports. We also don't modify protocol fields nor inhibit or favor any application or class of applications. The Provider may take part in any of these activities, so you should review the Provider's disclosures regarding their application-specific practices which may affect your use of the Service.

LIMITATION OF LIABILITY

Homestead Internet shall not be liable for any delay or failure to provide service at any time or from time to time, or any interruption or degradation of service quality that is caused by any of the following:

  • an act or omission of an underlying carrier, service provider, vendor, or other third parties;

  • equipment, network, or facility failure;

  • equipment, network or facility upgrade or modification;

  • force majeure events such as (but not limited to) acts of God, acts of nature, strikes, fire, war, riot, acts of terrorism, and government actions;

  • equipment, network, or facility shortage;

  • equipment or facility relocation;

  • service, equipment, network, or facility failure caused by the loss of power;

  • any act or omission by you or any person using the service; or

  • any other cause that is beyond Homestead Internet’s control, including, without limitation, a failure of or defect in any hardware, software, or equipment, the failure of incoming or outgoing communication, or the inability of communications to be connected, forwarded, or completed.

In any event,  Homestead Internet’s aggregate liability under this Agreement shall not exceed the service charges with respect to the affected service for the applicable time period.

DISCLAIMER OF LIABILITY FOR CERTAIN DAMAGES

In no event shall Homestead Internet, its employees, affiliates, or agents have any liability for (1) any special, indirect, exemplary, incidental, or consequential damages resulting from Homestead Internet’s provision or failure to provide any equipment or services to you, or from any fault, failure, deficiency or defect in service, labor, materials, work or equipment furnished to you by Homestead Internet or any other party, (2) any claims or damages arising from information or content which you receive by using the equipment or service, or (3) any delay or failure by Homestead Internet to perform its obligations if such delay or failure arises in connection with any acts of nature, fires, earthquakes, floods, strikes or other labor disputes, unusually severe weather, acts of any governmental body or any other cause beyond Homestead Internet’s reasonable control. The limitations set forth herein apply to claims founded in breach of contract, breach of warranty, product liability, tort, and all other theories of liability and apply whether or not, Homestead Internet was informed of the likelihood of any particular type of damages.

Change in Terms and Conditions

Homestead Internet reserves the right to change this Membership Service Agreement at any time. If we make any changes, we will provide you with notice of those changes in accordance with applicable law. This may be provided on your monthly bill, as a bill insert, through a newspaper, by email, on our website at https://www.homesteadinternet.com, or through other permitted communications.

​

If you do not cancel your service after receiving notice of such changes, your continued receipt of service from us will constitute acceptance of these changed terms and conditions. If you notify us that you do not accept the new terms and conditions, then we reserve the right to cancel your service.

​

Severability

If any part or provision of the Agreement is legally declared invalid or unenforceable, that part or provision will be construed consistent with applicable law as nearly as possible, and the remaining parts and provisions will remain in full force and effect. Such invalidity or non-enforceability will not invalidate or render unenforceable any other part or provision of the Agreement.

IMPORTANT

By signing the Membership Services Agreement and/or activating or using the Service, you agree to comply with all applicable laws, regulations, terms, conditions, and provisions contained in the Membership Service Agreement, Field Service Agreement, and any applicable service tariffs, terms and conditions of service, the Acceptable Use Policy and your selected service plan or service package. If you do not accept these terms and conditions of service, please notify us prior to installation and we will cancel your service.
